What is the EB-5 Regional Center Program and who is CMB Regional Centers?

Several countries around the world offer residency by investment or citizenship by investment programs. The United States’ immigrant investor program is called the “EB-5 Program” which requires an “at risk” investment by the foreign national and the creation of at least 10 new American jobs in order for applicants to obtain permanent residency. The Congress of the United States established the EB-5 Program in 1990 with the intent to stimulate the U.S. economy through job creation and capital investment in the U.S. There are 10,000 EB-5 immigrant investor visas available annually and two distinct pathways under the EB-5 program: the Regional Center Program and the Direct Program. Roughly 98% of foreign nationals pursue their EB-5 visa through the Regional Center Program.
Under the EB-5 Regional Center Program, the foreign national invests through a Regional Center; a Regional Center is an entity that is authorized by the USCIS, a component of the Department of Homeland Security, which is responsible for administering the EB-5 Program. A Regional Center’s authorization includes its ability operate within a defined geographic area in the U.S. and U.S. territories and to utilize economic modeling to determine the indirect and induced job impacts related to the foreign national’s investment. The Regional Center typically offers Limited Partnerships in which multiple foreign nationals invest to, more likely than not, meet the requirements of the EB-5 program. The EB-5 Program requires that the foreign national make a capital contribution of either $500,000 or $1,000,000 in a new commercial enterprise located within the U.S. The capital contribution depends on whether the investment is a Targeted Employment Area (“TEA”) which would allow for the lesser capital contribution. A TEA is defined by law as a rural area or an area that has experienced high unemployment of at least 150 percent of the national average.
Simply put, EB-5 is a program allowing for lawful permanent residency by investment into the United States. A single investment may allow for the applicant, their spouse and any unmarried children under the age of 21 to receive a permanent visa (Green Card). The EB-5 program requires, amongst other things:
• A minimum investment of $500,000 USD if located in a TEA (otherwise $1,000,000).
• Each investment must result in the creation of 10 new American jobs.
• A possibility of gain on the investment as well as the risk of loss.
Once the investment is made, the program requirements are met, and a permanent green card is received, the applicant (and their qualified family members) become lawful permanent residents of the United States, which provides for many benefits such as:
o There is no future requalification.
o Permanent residents are able to pursue educational opportunities within the United States at a lower cost and with fewer barriers.
o Permanent residents can live, work and travel anywhere within the United States.
o Permanent residency provides a pathway to U.S. Citizenship.
While Regional Centers are authorized by the USCIS, the authorization only allows the Regional Center to do business in the EB-5 industry. There are 930 Regional Centers authorized by the USCIS as of April 2, 2018. Over time, each Regional Center develops a track record as it conducts business. The track record of the Regional Center is directly reflective of the success of the foreign nationals that have trusted and invested with the specific Regional Center. Choosing a Regional Center is one of the most important steps in the foreign national’s EB-5 process. The Regional Center is responsible for creating Limited Partnerships to meet the foreign national’s primary EB-5 goal: permanent residency.
CMB Regional Centers is one of the oldest and most successful Regional Centers in the EB-5 industry. CMB has raised over $2.8 billion in EB-5 investment capital which has been combined with approximately $10 billion in public and private funds. This combination of capital and the multiplying effect of spending is projected to generate over 143,000 (direct, indirect, induced) new American jobs. Over 5,200 foreign nationals have chosen CMB Regional Centers to pursue their immigration goals through the EB-5 Program, with over 2,250 having already obtained their conditional permanent residency, and 1,000 having obtained a permanent green card for themselves and their qualified family members (with the rest pending adjudication). Additionally, over 600 immigrant investors in the first 11 CMB EB-5 partnerships have received a return of capital from the partnership.
CMB believes the USCIS adjudication of each CMB EB-5 investment is easily understood since all CMB partnerships follow the same transparent, conservative, and time tested structure. USCIS adjudicators have reviewed and approved 56 of 66 CMB EB-5 partnerships, with the rest pending adjudication. CMB EB-5 partnerships have a 100% track record of success at all stages of the EB-5 process.
